Mediation
Family
Mediation is the process in which divorcing or separating couples
are seen by neutral third parties to assist them in coming to an
agreement about the areas relevant for them. These may include:
Financial
arrangements
Division of property
Arrangements for their children
Our
mediators have undertaken mediation training with Resolution. We usually adopt a co-mediation model using
two mediators (neutral to either party), one family mediator and one lawyer mediator. The
mediators' different professional backgrounds reflect the fact that
the breakdown of a relationship involves both legal issues and emotional
concerns in which many conflicting feelings are felt by the individuals
involved. Impartiality is maintained throughout.
The
advantages of Mediation include:
A reduction in the feelings of hostility
Mutually agreed outcomes (rather than outcomes imposed by the court
or negotiated by others)
A
greater focussing upon the needs of the children
Confidentiality
Outcomes which are more likely to be implemented
Cost effectiveness (mediation is cheaper than litigating disputes)
Opportunity for legal advice in parallel with mediation
